TOYOTA'S DELAY IN INFORMING THE PUBLIC OF THE DEFECT IN GAS PEDALS JEOPARDIZED SAFETY OF CONSUMERS
On January 21, 2010, Toyota announced the recall of 2.3 million vehicles in the U.S. to fix accelerator pedals that can become stuck.
This comes just months after Toyota recalled 4.2 million vehicles over concerns that accelerator pedals could become lodged under floor mats, causing sudden acceleration.
Toyota first recevied complaints in March, 2007, regarding its Tundra pickup. But after an investigation, Toyota concluded in June 2008 "that while the accelerator pedal feeling could change under certain conditions, Toyota considered it to be a driveability issue unrelated to safety".
When the problem then showed up in two models in Europe from December 2008 to August 2009, Toyota lengthened the arm of the friction lever in the pedal and changed the material.
From October 2009 to January 2010, Toyota received reports from the U.S. and Canada regarding sticking accelerator pedals, prompting them to issue the recall.
"It isn't a matter of safety with these big corporations, it's a matter of profit" says Personal Injury Attorney, Arnold Laub. "Toyota has known about sticking accelerators since March of 2007, so why did it take them so long to issue the recall?"
Under Federal law, 49 USC 30118(c), Toyota was required to notify the Federal Government, Dealerships and owners once they learned the vehicles contained a defect which jeopardized safety.
"The bean-counters in all of these large corporations, make a decision: How much would it cost to fix a particular problem as opposed to how many lawsuits they're going to have to pay out for deaths and injuries".
